Legal Question in Family Law in Washington

We have a parenting plan that is one week with me(mom) and one week with her dad. We need to change the parenting plan. My daughter keeps asking for every other weekend with her dad or if we can just move away. Would moving away help with changeing the plan? Thanks!

Dear Kriss:

You don't say how long you've been in this 50/50 arrangement, but if things have changed for your daughter to the point where it is in her best interest to spend less time at dad's home than your home, then you can file a petition to modify the parenting plan based on your daughter's changed circumstances.

Moving away just to get away from dad is fraught with issues, namely, if you are honest and admit why you are moving, you will most likely not be allowed to move. Typically you move because of a job, or lack of one, or some other reason that serves the benefit the child more so than remaining at her current location where the father can see her. If however you move, just to get away, that's a non-starter for the courts and you will lose.
