Legal Question in Landlord & Tenant Law in Washington

3 day pay or quit in WA

If a Landlord serves you with a 3 day pay or quit for $75 and I chose to quit, can I be sued for the remainder of the lease (9 months) or if not at all?

Potentially the landlord still has the right to file suit against you for whatever reason they think they can prevail. That said, generally what the landlord really wants most is the possessory interest in the property. If you don't have enough money to pay rent, it is going to be a long, difficult process to get more money out of you, especially when this is a debt that is dischargeable in bankruptcy. A smart landlord will cut their losses.

Sometimes the better decision is to leave. The Supreme Court recently issued a decision determining that the 3-day period is consecutive calendar days, so you can't rely on holidays to extend the notice period any more.

Hope this helps. Elizabeth Powell
