Condiminium responsibility or mine?

I own a condo, one of 11 units in the building.My sink and air gap was spewing forth water when I returned home one day. The water flooded my kitchen, hallway, some of the dining room and small bedroom. Most of the damage was confined to wood floor and carpets, with only an Indian rug of my personal property damaged.

The cause was a blockage in the drainage line below my condo, and any or all of the three owners above me share that line. Condo insurance will cover all but $1000 of the flooring repairs, and say that my personal property insurance will cover the rest, less my $250 deductible. Is this right, that I must pay $250 because I am in the lowest unit, the point of least resistance to water overflow, and others who share the line pay nothing?

Write a letter with your complaint. If inadequate response, try small claims court: no lawyers allowed, inexpensive and fast (usually). Consult with an attorney on how to present your case in small claims court. Damages limited to $2500.
