Legal Question in Real Estate Law in Washington

Our Homeowners Association is having a deputy over County owed Property.

The Plat map shows the road as being 30 ft. from the center. Our dead end street

is not 60 ft wide and all of homeowners' front yards are into part of the 30ft county owed property.

Question: Can a neighbor remove part of anyone's present yard for their

public use or can only the County do that?

Generally speaking, no one other than the county has a right to use that property - but, of course, almost everyone uses the portion of the right- of-way not used for the road. Your neighbors - or anyone else - does not have some right to use that property...to the extent they want to walk over it and not disturb your property - fine- to the extent they damage things you have in the right-of-way..not fine.

Your question really begs the question...What is really going on?
