Legal Question in Traffic Law in Washington

traffic stop

I was stopped tonight for having expired tabs. I don't have a license, but was driving a friend's vehicle. The tabs were misplaced, but the vehicle owner did in fact purchase the necesary tabs. Can i fight this in court as there was no probable cause to pull the vehicle over. I wasn't doing anything else illegal at the time.

Re: traffic stop

Operating a motor vehicle upon a public road with expired tabs is a violation and is sufficient basis for a traffic stop. There need not be any other violation.

The violation is committed by the driver, not the owner of the vehicle.

You should contact the prosecutor and provide proof that the tabs had been purchased. Ask for a dismissal, reduction or some other disposition based upon mitigating factors.
