Re: whether internal environmental audit is protected from discovery

The answer to this question is that it depends. I am not a member of the West Virginia Bar, however it can be protected in the Federal sense under certain circumstances. Check with your local attorney to see the ramifications of the situation. If there is a court order either from a state or federal court, I doubt that it can be protected.
