receiving custody of 1 child (out of 2)

custodial mother is considering turning over custody of one of two of my kids, age 10, soon to be 11 in june. What is the procedure. How will it effect the child support now paid? And how is the support calculated in the state of WV? (Would greatly appreciate the formula if possible) Thank you.

Get court approval

The proper way to change custody is to get approval from the court that ordered custodybefore. Since violation of a court order is a contempt, failure to obtain court approval couldcause problems. In my state, if both parties agree, in writing, to a change of custody, it is aquick and inexpensive matter to obtain court approval. I don't know the child support formulain your state but you should check the child support guidelines for West Virginia.
