Legal Question in Family Law in West Virginia

restraining order

what usually happens in cases where the wife wants a restraining order based on allegations of abuse of her and the children ages 8 and 11? What proof of abuse does the judge take into consideration? Will I go to jail if found guilty?

Re: restraining order

Well if the court grants the petition of your wife for a restraining order you will be prohibited either to have physical contact with her/children or go to a certain radius from whence your wife/children are staying. This is a some sort of protection for your wife and children from allegations of abuses. The proof could be medically proven such as the bruises sustained by your wife/children, if there be any, or the testimonies of witnesses who saw the alleged abusive acts. You can go to jail if your wife files a criminal case arising from the physical abuse/s she/children had sustained and if you are proven guilty.
