Legal Question in Civil Litigation in West Virginia

Signed for boyfriend's (now ex) vehicle

I signed for a vehicle for my boyfriend and we have now broken

up.He has paid the payments for the last 14 months but I would like

for him to refinance it in his name only because I don't want my

name on the insurance policy and have no desire to have the truck.

I am considered the primary owner and he is the secondary. The

insurance company says my name has to be on the policy since I

have an interest in the the truck. Is there any way I can get my

name off the title if he refuses to refinance in his name. It is on my

credit report and has affected my ability to increase my home equity

line of credit because it looks like I have more debt tthan I actually

do.

The Circuit Court has jurisdiction to settle the matter for you. You could even secure a Temporary Restraining Order to pervent him from driving until he takes your name off of the title. This may require refinance. There is cost associated with such a suit. You ought to consult a lawyer to see if a less costly remedy is suitable for your situation. Perhaps you could give notice to the former boyfriend that you intend to cancel the insurance. He will have to secure his own insurance and in order to do so, secure title in his name only. A remedy along these lines is risky. You want to avoid a situation where the vehicle is driven without insurance.
