Legal Question in Civil Litigation in West Virginia

Truck accident gone wrong

My fiance wrecked his vehicle and did not have insurance, we can not afford to get legal help, we don't have any money to start with but if all of his bills and everything is in his name can they still try to collect out of his paycheck. What are some other tips you also might be able to provide on an uninsured motorist being sued, so far they say 35,000 +? Thanks for any help you can give.

Re: Truck accident gone wrong

Your situation involves several issues. Insurance coverage is the first. Check to make sure there is no coverage for the accident. Coverage may be found in a policy issued to an adult family member in the same household or because the insurance company improperly denied coverage or because the driver was an agent of someone else at the time of the accident. If you are sued, you should spend some money on your defense by consulting a lawyer to either represent you or advise you how to represent yourself. Normally, a passenger, girlfriend, relative, etc. is not liable for the actions of a motorist driver. There are exception but, as with the insurance issue, all the facts must be evaluated.
