Legal Question in Personal Injury in West Virginia

Boating Accident

I recieved a broken arm in a boating accident. My husband was driving the boat when he lost control and my arm got caught between our boat and a docked boat. I will be off work for approx 4 weeks to 6 weeks. We have insurance on our boat. Our insurance adjuster says that I will get lost wages from the accident. She also ask me if I wanted compensated for the accident and is sending out forms for me to fill out. My question is: Is this compensation for pain and suffering? And if so what is a fair price?

In West Virginia and other states, the courts have recognized that a claim between husband and wife for negligence is not contrary to public policy. This is because insurance coverage takes away the problems which may be caused in the family household. Thus, you would be entitled to recover pain and suffering along with medical expensed, lost wages and the value of residual injury.
