Legal Question in Personal Injury in West Virginia

Personal injury/car accident

My father was a passenger in a vehicle that was rear-ended in November 2006. He saw several doctors and a local lawyer who took his case. He had a heart attack and died on 12/31/06. The lawyer stated they would finish the proceedings and contact me. Recently I received a letter that stated the insurance company would pay $7000. My siblings and I are wondering if this is the right amount of money. Although he did have a heart condition prior to the accident, we feel the that the stress of his injuries as a result of the accident may be linked to his heart attack.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such nformation, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

It is impossible for any attorney to give you any real idea without reviewing the file and all medical records. There are so many factors that get involved in a personal injury lawsuit and any settlement. Anyone making a comment would only be guessing.

Unless you can get a doctor to testify that his heart attack was caused by or was contributed to by the accident (unlikely) the settlement sounds within range for an accident involving soft tissue injuries (no broken bones, disfigurement, etc.)
