If someone is being looked at under the PATRIOT Act and it is learned that the only offense they are committing is welfare fraud here in the U.S., can the information gained through the Act be used to prosecute them for Welfare fraud?

Yes. If the information was revealed in a legal search, it may be used to prosecute the defendant for a crime that is different from what was being investigated.
