Child Born From a One-Night Stand - How Responsible is My Husband?

My husband had a one night stand 2 years ago, the result of which was achild. The mother was married at the time, but is in the process of a divorce. Her soon-to-be ex- suspected that she had been unfaithful(apparently my husband was not the only one she was with) and demanded a paternity test. The husband's test was negative, she located my husband and his test was positive. We want nothing to do with this child, but my husband will pay the support as ordered by the court. A Guardian Ad Litum was assigned due to the suspicious nature of her affairs & such... The mother is now in a relationship and plans to marry this man, but my question is: how responsible (financially) is my husband now? How will it change if she marries her boyfriend? If my husband and this woman agree to settle out of court, can the Guardian demand something different? Help?

Your husband is responsible for child support in the amount of 17% of his gross income,plus insurance expenses. The fact that you don't want anything to do with the child is irrelevant. One possibility might be that if the mother's new boyfriend wants to adopt the child then your husband can terminate his parental rights, which means he is no longer financially responsible for the child.
