Battery of a minor by minors

My niece was set up by a 14 yr old and was beaten by two others youths in a house. What legal recourse do we have? the case is going to the D.A.s office. Her glasses were broke and she spend a couple of hours in the hospital.

Wis. Stat. sec. 895.035 (2001-2002) provides that the parents having custody of a minor child who causes personal injury are liable for the acts of the minor child. Thus, your niece may have a claim against the children who injured her and against their parents having custody of the minors. Assuming the names of the children and their parents become available, someone will have to determine whether it is worthwhile pursuing a case against them to recover compensation for the injuries suffered by your niece. Your niece would probably be intitled to recover punitive damages, as well as compensatory damages.
