Legal Question in Wills and Trusts in Wisconsin

settlement of property

My father passed away owning an apartment in Plymouth, Wis. My siblings and I have paperwork stating who would get the monies when my step mother vacates the apartment. Her attorney and apartment manager says that in Wis. all properties/monies go to the living spouse to do whatever she wants. If she chooses she can keep all monies from the apartment she can or divide it amongst whomever she chooses. She does not have to give any of the monies to the children of the deceased. I would like to know the Wis. laws on probate settlements before she sees her attorney next week to do a will regarding this matter. I'm sure each state has their own probate laws, but with me here in Texas and her in Wis. it makes it a little hard to know if she is telling me everything. I feel as if my parents have died all over again and every bit of their remains have been taken from me. Please help me out and explain to me exactly what I need to do or say to her to be able to get what is rightfully mine.

I am not a WI lawyer, but I find it hard to believe that what they are saying is true. Please call a probate lawyer in the county of your father's residence and discuss the issue with him or her. Most will give you a free initial phone consultation to see if you have a case.
