I am trying to fight for custody of my 8 year old daughter (who currently is living with me) against her mother in wyoming what dictates which state has jurisdiction?

If the child has been living in California for at least 6 months and there is no current order for custody, then California has jurisdiction. If the facts change from those, the answer may change. You should see an attorney before you make a mistake and need to fight custody in the wrong state. Good Luck, Pat McCrary

The Uniform Child Custody Jurisdiction Act which has been adopted in Wyoming will determine which state (or states) have jurisdiction and which court should exercise jurisdiction. It is critical that you speak to an attorney and provide the history regarding your child's residences and the court orders regarding the child. Thanks and good luck!

If the child has been living with you for at least 6 months, then California has jurisdiction. If not, then it may still be possible to file a motion for a change of venue based upon Forum Non Conveniens.
In any event, you really need to retain an attorney to assist you in your custody battle. The legal fees will be money well spent.
