Re: Death without a will

Death without a will, or intestate succession is governed by Wyoming Statutue 2-4-101 through 2-4-213. Esentially, if there is no spouse but children, the children receive the property , and the descendants of the children who are dead, the descendents collectively taking the share which their parents would have taken if living.

The devise to the minor child is governed by the Uniform Transfers to Minors Act 34-13-114 et seq. Basically, the property is transferred in trust for the benefit of the minor.

These are very complicated issues, and a few moments spent with an attorney talking about specifics will benefit you more than the type of general advice that can be given in this format.
