Legal Question in Banking Law in India

DEAR SIR,

MY SELF SAI FROM HYDERABAD,MY DAD HAS TAKEN A HDFC BANK CREDIT CARD AND MAINTAINED THE CARD FOR 10 YRS APPROXLY AROUND 3.5LAKHS HE HAS USED AND PAID MINIMUM AMOUNT MONTHLY AROUND FOR AROUND SINCE NEARLY 8-9 LAKHS.

NOW HE GOT RETIRED AND HIS AGE IS 50+YRS NOW THE RECOVERY GUYS AND BANK PEOPLE ARE SHUNTING AROUND US AND ALSO USING SOME ABUSING WORDS EVEN AFTER SAYING THAT THE SUPREME COURT HAS GIVEN THE JUDGEMENT THAT YOU SHOULD NOT COME AND SAY LIKE THIS BUT THEY ARE EVEN CARING THE JUDGEMENTS OF SUPREME COURTS.AS WE HAVE TRIED TO SETTLE THIS ISSUE SO WE ARRANGED 2-3 SITTINGS BUT THEY ARE NOT GETTING SATISFACTION WITH OUR FIGURES.SO I WOULD LIKE TO KNOW FROM THE EXPERTS i.e CAN I FILE A COMPLAINT IN BANKING OMBUDSMAN SO THAT I CAN STOP THESE RECOVERY GUYS FOR DOING LIKE THIS AND COMPLAINING THAT THIS IS THE ISSUE SO WHAT KIND OF RESPONSE DO CAN I GET FROM THEM.

DO BANKING OMBUDSMAN THEY ASK US TO PAY FULL AMOUNT AS U HAVE TAKEN AND AGREED AT THE TIME OF TAKING CREDIT CARD.AT ANY COST OR THEY SPEAK AND SUPPORT ONLY THE CUSTOMERS OR THEY SETTLE THIS ISSUE IN OUR END AS WE WISH AS WE DON'T HAVE THAT CAPACITY TO PAY THE AMOUNT AS WE BOTH SON AND DAD ARE UNEMPLOYED R8 NOW.

SO PLEASE HELP US IN SETTLING THIS ISSUE IN A COOL MANNER....AS WE DONT WANT TO FILE A CASE IN THE COURT OR POLICE STATION FOR DOING THIS ....

you can file a complaint to Banking Ombudsman about the harassment. How the Ombudsman will decide cannot be predicted. If you are not satisfied by the decision of Ombudsman you can appeal to the appellate authority of RBI. If your father is unable to pay the correct outstandings, better file a complaint to the police against indimidation by the recovery agents, and ultimately file for insolvency to put an end to the indebtedness. Better have the assistance of a local lawyer.
