Legal Question in Civil Rights Law in India

Dear Sir, There is a 150 or 100 yrs old house in a small city of Rajasthan, where my father in law and all family members lives from last 100 years ago...at the ancient time landlord given to this house to our family to live there and at the same end my family has to work as a servant of them...the landlord generation was cared and nurtured by our family...so there is no agreement of rent between my family and landlord family...we living there from past 100 yrs back...light and water connection are the name of my father in law...same rashan card and voter card running with name of my father in law...now landlord son's want to get out us from that house just because land property price is rise too much..we don't have any other house to stay but they used their force...even there we are unable to construct anything where house is too old to live...what we do...can we get possession of that house so our whole family can live there happily without any force action of landlord

if your Father in law's possession was undisturbed for more than 12 years, he became the owner by adverse possession. If you all have been dispossessed then file a suit for recovery of possession u/s 6 of the Specific relief act within 6 months of dispossession. You may drop in a detailed query at [email protected]

You should look for and fetch an alternate accommodation for your family, if the landlord wishes that you vacate the premises.

You are having the right over the property by adverse possession. with the help of the said documents showing possession, file a civil suit for injunction restraining them from evicting you from the said house except under the due process of law. If they move the court for eviction, you have got a good chance of success.
