Legal Question in Civil Rights Law in India

Sir, I filed a complaint with Mylapore E1, Chennai, Tamil Nadu, India-600004, police station and got a CSR No 212 for the same. The complaint is regarding encroachment on the common passage for which a permanent and mandatory injunction is already in force. An SI made an inquiry into the incidence and after due deliberation asked myself and the other side to give it in writing what are our points of view on the issue. While I gave it in writing that I am forced to seek legal remedy again since the other side is not willing to remove the encroachment, the other side submitted that he is ready to remove it if other neighbours too raise an objection over the encroachment and ask for its removal. After this, when I requested the SI to give a copy of the letter submitted by the other side to the police station, the SI said he could not give a copy of that since the submission was given to police only. My question is am I not entitled to a copy of submission made by the other party on a matter concerning me, that too to submit it as evidence to make a submission to court? One more question. Is there any limitation for filing a contempt of court application for violation of mandatory and permanent injunction pronounced by High Court?

Dear Sir / Madam,

The Sub Inspector at the Mylapore E1 Police Station in Chennai is bound by law to furnish you with a photocopy of the opponent's statement for onward submission to the Court. Addendum to on-going hearings can be filed till the Judge hearing the matter closes the case for release of final Order.

1. You may summon the police record by filing an application in court.

2. Limitation for contempt is one year from the date of cause of action.
