Legal Question in Family Law in India

Dear sir,

I am an Indian Hindu 52 year women and my husband is 55 years old. We don't have any children. My husband's elder brother's son is living with us since his birth in 1990. His mother passed away in 1997 we have been supporting him in his education till date. We wanted to adopt him but my brother in law never let us do that. He left his son and was away for 16 years and he did not remarry. Since a year, he is in touch with us. We expressed our desire to adopt his son who is 23 years old now and he has agreed to it. He is currently presuing Post graduation course. Even he is interested. We are financially sound and we want to adopt him and want to be legal heir. Can we adopt him now? What is the procedure for the adoption? Please guide us.
