I want divorce but my wife has filed section9. she wants to live with me but I don't want.

what should I do? Before departing it was her and her family members' wish that we should get divorce as we had small small many quarrels. when I agree she denies. It is 2 years we are separated. what to do?

try and amicably sort out the issue. There are mediation centre in court get the case referred for mediation and things might work out. If you still dont want to stay togather you can file a divorce by mutual consent. This will save you the time energy and money. If have filed for divorce against your wife, you must be having strong grounds in your favour over which you are asking for the divorce decree.

The same has to be established before the court of law, failing which your petition shall be dismissed. In your case, wife has filed for a Restitution of Conjugal Rights, after 2 years of separation.

You may contest the RCR and shall have to show proper and sufficient ground as to why RCR order shall not be passed against you. You may contend that the wife has been living separately for 2 years and give the evidences as to why RCR petition should not be passed by the court.
