Legal Question in Employment Law in India

An employee joined in our organization and immediately after 1 month, he abscanded for 2 months, again he requested and again we provided an opportunity, he asked about the previous month expenses, we asked him to work first, and we will clear what may be the possible amount, again he stopped working, and threatened us with the help of a constable, hence, we asked him to resign and he gave denied to resign, nor he is interested to work. Hence, we gave a letter that, we will finalize his final settlement as per the discretion of the management with in 25 days. But, we are unable to process that, due to the financial crisis in the company. Now, he is ready to file an f.i.r on one director of the company. He can do that as per law?

You have relief and move out your such employee from the firm.
