Legal Question in Landlord & Tenant Law in India

I rented a premises in 2009 in Hyderabad. the landlord did not make a rental agreement with me inspite of me requesting him. He died last month. The property is in his daughter's name and now his daughter & son-in-law are forcing us to vacate the house. Kindly tell me what I should do?

Dear Dr. Sanjay,

Even if the deceased house Owner were to make an Agreement for Leave and License (ALL) with you, it would have been for a period ranging from 11 (eleven) months to maximum 3 (three) years. In your case, since you leased the premises in 2009, it implies that the maximum permissible 3 (three) year period expired in 2012 itself. In my view, if the present circumstances and situations require you to still prolong your stay in the same premises, you should amicably negotiate the terms, especially the monthly compensation, based on the prevailing market rate for similar premises in the vicinity. If the premises Owner(s) still disagree thereupon, you should seek an alternative accommodation.
