Legal Question in Landlord & Tenant Law in India

Sir.i am running a tea and coffee shop on railway land.our shop is 80 years old and we are paying rent to railway regularly since beginning.this shop is alloted to my grandfather who died in year 1993.now in year 2014 railway is not transfering the land to my grandmother or any of us and asking to leave the shop.

Dear client,

Even if you are paying rent very promptly and occupying the premises will not gve you any right to continue the shop. But as dependents of licensee you can continue till the lease period ends. Keep cool and do business and pay rent promptly . At a point when you get a notice for returning the premises to railway, you may consult an eminent civil advocate and move for an injunction restraining railway from evicting you from the premises and state that the entire family is depending on this shop for livelihood by filing appropriate applications in court. Once the injunction is granted to you it will go smootly atlleast 2 to 3 yes maximum. Since this method is experimental, very good amount of risk factor is also there. You may file another application along with this suit to direct the railway to allot a stall at reasinable rent also. Remember that all these things are depending on your luck.
