Legal Question in Real Estate Law in India
We have 5 Bigha Agricultural Land in Uttar Pradesh having equal proportion of 2.5 bigha each of two brother. Both Land are far from each other (Two "Chak" 2.5 Bigha each) The land has not been partitioned yet from both "Chak"
We have been cultivating on the land for the last 20 years.My uncle has partitioned the land in the absence of my father and cultivating without my father's permission who is co-owner. There was no member of my family at the time partition. Was it justified?
Please also suggest, how will i be able to stop him to cultivate at my "Chak" ?
What is the procedure to take injunction order from court to stop him?
Please help.
