Legal Question in Wills and Trusts in India

My father was in govt. service and now not alive. My mother is alive and getting family pension. We are 2 brothers and 2 sisters all married except me. All cash and property earned by my father are IN NAME OF MY MOTHER and are in totally possession of my brother. My brother and mother don't want to give any portion in cash and property. Family pension is Rs. 20000 and completely used by my mother and brother.

I have a paper written by my father in which he has written that pension will be divided in this manner - 50% to my mother, 25% to my brother and 25% to me.( family pension is not usually divided , since there is not any legal rule, but it becomes essential when pension is more, because high injustice in partition of pension may finish life of old pensioner.) The paper is signed by two witnesses, both of them are in govt. service. There is no other such paper available.

By help of this paper, I want to make an arrangement legally, by which I will get half of cash and property either now or after my mother(failure of such arrangement will give all cash and property to my brother). How is it possible legally by any way ? Please guide me.

i have answered to your question earlier too. I am surprised that instead of taking care of your mother you are concerned about her pension. Are you not earning. You want life long support from your parents what will be your fate if god forbid she dies?/ Should the state support you then? you are fighting for Rs 5000/-. Give your mum love and happiness without demanding anything. I think your father did the right thing by giving all his assets to her.
