Legal Question in Bankruptcy in Alabama

divorce, husband, bankrut,and creiti card

i got a divorce we were in bankrut he is to pay bankrut he stoped paying and now creit card wants me to pay because it is in my name it has been 7 years divorce and about 6.5 years he has not paid bankrut. what can card do to me? how long can card keep calling me?

If it has been over 6 since years since any payments or charges have been made on the account, then the debt collector cannot sue to collect. They can continue to call, BUT it is likely that since the debt is so old that the debt collector is violating the Fair Debt Collection Practices Act. You need to Dispute the debt. Send a letter telling them that you don't owe the debt.

The statute of limitations is 3 years for an open account and 6 years for a contract so your statute should have RUN OUT by now.

You MUST DEFEND any lawsuit against you. You MUST send a letter denying the debt everytime you get a letter.
