Legal Question in Credit and Debt Law in Alabama

credit card debt

I have a debt management program which the credit card companies are say they won't accept and they're threatening to garnish my wages if I don't pay them directly. If I can't afford to pay them separate can they really garnish my wages or will it just be put on my credit? In the state of Alabama can they really garnish my check?

Re: credit card debt

A corporation does not always have to accept a debt management program unless contractually bound by Agreement or the result of a Bankruptcy Decree (Chapt. 13).

In the State of Alabama they may garnish in some situations; however, many things come into play here. Is there a judgment against you? Have you allowed this debt to become secured? Did your failure to pay a bill violate the terms of a Payment Agreement?

I would direct this question to a local bankruptcy lawyer but first visit the site below: http://www.fair-debt-collection.com/state-garnishment-laws.html#1 I think it is a good site to get familiar with your situation and direct you to relevant state code sections.
