Legal Question in Criminal Law in Alabama

Seizure of Personal Property Automobile

In Dec 02 my automobile was apparently seized during an arrest at a location in AL. Vehicle is tagged, etc in TN. To date, no notification of any type has been received by the registered owner. AL attorney has said it would be other than criminal court. Is State of AL required to notify the owner of seized vehicle? If so, through which state agency? Also, is there a time constraint, on either side, regarding disposition of vehicle?

Re: Seizure of Personal Property Automobile

I assume that you are the registered owner. Was it seized by local police or the feds? Either way, they typically won't notify you individually about the vehicle. Your best bet is to contact the agency directly and find out the procedure for recovery of evidence. If the vehicle is being used as evidence, however, you won't be able to get it back until the case is over, either after trial or after a plea bargain. Good Luck.
