Legal Question in Family Law in Alabama

Fathers Rights. I have an ex who is pregnant. She says the baby is mine but also says she cheated on me. She wants to put the baby up for adoption. I would like a paternity test when the baby is born. I would like to know if she does put the baby up for adoption can I still have the paternity test done and if the baby is mine will I have a chance to fight for it before it is adopted?

Absolutely. If you are the father of the child, she cannot put the child up for adoption without your consent. If she has made it clear that she does not want the child, then she should be willing to sign the child over to you. You could petition the court for custody and request that she be ordered to pay child support, and she would also receive visitation rights to the child. Or, if you wanted to take her completely out of the picture, you could ask her to agree to a termination of her parental rights. You would be solely responsible for the child from that point forward, and she would not have rights of visitation or custody. However, you would also lose the right to seek child support from her.
