Legal Question in Family Law in Alabama

My mother is taking my children to her house which is out of state for a week. I am sending copies of their social security cards and a copy of my insurance card. Should I also send some sort of letter stating that she has my permission to make medical decisions if some sort of injury were to happen?

If your child is in an emergency, the local hospital will treat your child regardless. What you could do is sign a "LIMITED power of attorney" solely for the health and welfare of your children. This would give your mother the same rights you would have to put the children in the hospital (non-emergency) and consent to treatment and should be admissible in any state. A "limited power of attorney" is a notarized document that any lawyer can draft for around $100 to $150. Make sure it is LIMITED to medical issues only and does not allow the other person to consent to adoption or removing the age of minority for marriage.

As a practical matter, if your mother takes a child to a "doc-in-a-box" type facility those facilities normally do not ask for "guardian" documents - they simply ask "are you the legal guardian".
