Legal Question in Medical Leave in Alabama

I was in a car accident and put on flma. I was albe to return to work before time was up, My employer gave my position to another, now they are telling me that I have no position there. Can they do that?

It depends. If all FMLA qualifications are met they must restore you to an equivalent position with no loss in pay or benefits. You must work for an employer who has 50 or more employees within 75 miles of your work site, you must have worked there for more than one year and worked over 1250 hrs inthe last year.
