Legal Question in Personal Injury in Alabama

Back and Neck case-auto accident

Wife's car was rear-ended. Wife was slightly injured, but not severely; the doctor says the x-rays show muscle spasms and a possible disc problem. Car is being totalled, and the insurance company is trying to settle the car for less than it's value. They won't even offer a settlement on the injury until ''treatment has been completed''. Should I take legal action at this point?

It is never easy to decide whether to take legal action. Obviously, as an attorney, I would recommend that you seek representation, especially since most cases such as these are taken on a contingency basis and cost you nothing unless a recovery is made. With respect to the car, you are entitled to the value of the vehicle before the accident less the value of the vehicle after the accident (salvage). You may also be entitled to loss of use and other incidental charges. Usually, it is not a good idea to settle the bodily injury portion until you know the extent of the injury. If your wife has a disk problem and it turns out to be a herniated disk, the complexion of the case changes significantly. Please call me if you would like to discuss this further.
