Legal Question in Real Estate Law in Alabama

New Homeowner needs help!

My grandmother bought a house for me, after closing long after, we discover that the new home that we bought was built on top of a old strip mine and later turned into an open landfill. I have 2 children who up until we moved here were barely ever sick, since we have been here both of my children have had significant increases in there sicknesses nad having done some research online I find that there are toxins in a landfill that if not properly ventilated can cause mager upper respitory problems, up to possible luekemia. Not only that but my house and the neighbors house included are having foundation problems and sink holes. We were never told of this land being reclaimed or being an old strip mine or even being a landfill. We found after hear say and then doing some research and finding all accusations to be true! Do we have a case? If so what? And since we have all suffered from constant sickness can that be included in a law suit? Who can we sue? What can we expect to recieve in a law suit if anything! Can we sue for enough to get another home, especially since it was so hard to get the first mortgage? Any suggestions please help!!!!!!!!!!!!!!!!!!

Re: New Homeowner needs help!

There are a lot of facts that would need to be reviewed to determine if there was any liability against the home builder or the title insurance company. Could be some TILA/RESPA violations in regards to the closing. Please feel free to contact my office to discuss.
