At the risk of being suckered into answering an obvious question, given the choice, why would anyone choose to proceed through probate without a valid will? Let's see- maybe they just like to throw away several hundred dollars or more for bonding. Maybe they like to hire an attorney each time some decision has to be made so a hearing can be scheduled. Maybe they prefer spending twice as much time in probate and spending five times the money that a will would've cost them. Seriously, this question can't be serious. No one would choose to go through probate without a will. Some people do but they don't understand that a will does a lot more than simply telling the world who gets your Beanie Baby collection. It saves the survivors thousands of dollars and months of time.
