Legal Question in Sexual Harassment in Alaska

My sister is 14; she has an 18 year old boyfriend. I know its illegal for people under 16 to have consensual sex in Alaska, (or at least that's how I understand it). She has been grounded several times for seeing him, but today she got into his car and left without telling my parents she was with him. She informed us, a full hour later when she finally came home, that she had not seen him (despite the fact we have witnesses that saw her in the car and my own mother watched her get in). Can her boyfriend be charged with kidnapping or anything like that? Is there anything illegal about this situation, or am I just overreacting? Thanks for any help you can give.

No. You are not just overreacting. If they are having sex, and they are fully 4 years apart (If, for example, she was born on October 1, 1996, and he was born on or before September 30, 1992), he is guilty of a felolny:

AS 11.41.438. Sexual Abuse of a Minor in the Third Degree.

(a) An offender commits the crime of sexual abuse of a minor in the third degree if being 17 years of age or older, the offender engages in sexual contact with a person who is 13, 14, or 15 years of age and at least four years younger than the offender.

(b) Sexual abuse of a minor in the third degree is a class C felony.

No. It wouldn't be kidnapping.
