Legal Question in Business Law in Arizona

How binding is a non compete clause in Az. I recently went to work for a carpet and tile cleaner and would like to go out on my own because the Owner is BI-Polar and needs some help but I did sign a non compete contract?

Thank you,

Kurt

We work almost exclusively with small and medium startup businesses. While we can advise you regarding what you can't do, more importantly, we can tell you what you can do. The law and the courts set forth the time periods and geographic ranges they have deemed enforceable, but it also depends to a degree on what you have agreed to contractually and your level of knowledge, and some other variables. We would need to review the contract in detail before rendering an opinion.

Kurt, the enforceability of a noncompete clause depends on numerous factors, especially what is drafted in the contract. You should have an attorney review it for you and advise you specifically rather than generally about something so important. In California, they have been effectively gutted, but they remain enforceable in AZ.
