Legal Question in Criminal Law in Arizona

petition to revoke probation

was placed on 4 years standard probation in 2001 for drug charges-10,000 restitution amount as well. No violations or write-ups til this year. I had met a man who I became friendly with. He would visit my home. Seems he was on parole and was on the run, as well..unbeknownst to me. He was apprehended at my home, which put me in violation for association. I paid the restitution in full 5 days after incident. P.O. has violated me with a bench warrant? I can deal with this. I would like to plead guilty and get it over with(as I know that ignorance is no excuse)What are my rights in regards to requesting to be released from probation early, versus being reinstated for 3 months of standard probation? I would like to be able to relocate to Oklahoma, where my daughter resides. Also, do I have any rights in regards to complaints as far as my P.O.'s handling of this? He has drug this out for 2 months now.Who can I go to above his immediate sup.? And do I also have the right if reinstated to request my {P.O. be changed for the remainder of time?

Re: petition to revoke probation

Having handled hundreds of probation violations in the past, the first thing you need to do is get the warrant handled. If you did not know that the person was on parole, this is a legitimate defense to your probation violation allegations. A petition can also be filed to terminate your probation, however, I am surprised that if you have been compliant to date, that the PO has not done this. As to complaints against the PO, don't waste your time, you won't get anywhere. If you are in need of representation, feel free to contact me.
