Legal Question in DUI Law in Arizona

First dui, very confused

Hi. I was pulled over a couple of nights ago and have to appear in court on Mon the 10th. I am so scared and have no idea what to expect. I asked the officer but all he would tell me was that it could go anywhere from the charges being dropped to being very severe. I had not been drinking for a few hours and blew a .081. A friend told me that my blood test will come back lower because the breathe test are always a little higer. Is this true? Also the offier said he was testing me because I couldn't follow the pen but it was night and he kept the flashlight directly in my eyes the whole tim so all I could see was spots from the light. He wrote impared to th slightest degree on the ticket. Do I have any options at this point?

Of course you have options. Hire a lawyer who knows what he's doing and stop listening to your friend.

You do have options.

There is no way to know at this point if the blood test will come back higher or lower. The portable breath test is not always accurate. Assuming it was correct your body may have stil been absorbing alcohol in which case the blood will be higher. If you were at a point that you were burning alcohol and no longer absorbing it should be lower.

What court are you in front of. This may affect the options you have. There are many issues that can come into play in your case. I would be happy to discuss the details with you, if you call my office during the day.
