Legal Question in Family Law in Arizona

Divorce

About 4 weeks ago I filed for Dissolution of Marriage with children, I also filed temp. orders for child custody etc. My husband is currently incarcerated and he will be in prison for about 1 yr and a half. I do not need the temp. orders. I want to continue the divorce, can I file a withdrawal for the Temp order and still have him served with just the Dissolution of Marriage?

Re: Divorce

Generally speaking, you can withdraw the request for temporary orders. You should contact the office of the judge assigned to your case to determine whether they will require you to do this in writing or whether you can do the request by phone. The court will appreciate that you are taking steps to avoid wasting the judge's time.
