Legal Question in Civil Litigation in Arizona

Sued for something I never received

When I opened a store account, it was to purchase items for a new home I was building. A refrigerator, washer & dryer, & mattress were to be delivered upon completion of the home. My fiancee' was pregnant with back problems so we chose to have the bed delivered before we moved into the house. The store hired an independent contractor for delivery & had my fiancee' sign for the delivery when they first got there but they couldn't get it thru the hall & were to take it back. I didn't get my home, cancelled the order & closed the store account which was never billed for months. Now I'm being sued for this bed because the independent conctractor never returned the bed to the store. The store should be suing THEM but my fiancee's signature is on the delivery sheet because she signed for it when she greeted them. Do I have a chance?

There is always a chance. Go to court with your lady and explain what happened as you have in this post.

Good luck.
