Taking money for a product not delivered

I purchased a vehicle on Ebay, the terms and conditions stated that the down payment of 10% had to be received within 3 business days. Contacting the guy through email, we decided it could be extended because I was waiting for financing to go through. My financing finally went through and I sent the down payment of $1430.00 to his home address via money order and insured mail.

A few days later my bank informed me that they would not allow the financing to go through because the car was not titled in Arizona (he lives in Florida). I tried for 4 other various loans and none went through. I emailed him back asking for they money, no response. I emailed him a second time asking for hte money and informing him i would get a lawyer involved if he didn't respond or send the money back, still no response. This has been over two months.

All emails are saved, the auction listing is saved, the receipts for money order and shipping are saved. What can I do to get my money back?

You may have to file a cause of action to recover your money but I would need to see the terms and conditions of the sale as well as any e-mails and other correspondence between you and the seller to determine how best to proceed.
