Legal Question in Real Estate Law in Arizona

Does Arizona allow a foreclosure saledate to be continued?

I have a pending foreclosure saledate coming up and I was wondering if Arizona allows a foreclosure saledate to be continued in the event that the lender and the borrower are working out a Loan Modification. Or, does the lender have to proceed with the saledate as planned? If the saledate can be continued, is there a limit to the amount of time they can delay the sale? My lender is very slow on the Loan Modification but is keeping mum on this issue

Trustee's sales can, and often are, postponed. There is no limit on the time the sale can be postponed by the lender. However, there is no rule that makes this a given. It is totally at the discretion of the Lender, the Trustee and possibly the attorneys involved.

You should be prepared that the sale will go forward because unless you receive confirmation that it is postponed, you are not protected. In this climate, it will benefit you to be persistent and not sit back and wait to be heard. Don't be rude, but don't be a wallflower either.
