Legal Question in Real Estate Law in Arizona

illegal foreclosure

Is it legal for an investor to do transaction with the lender without your consent? Let me start from the beginning I had an illegal foreclosure and I said illegal cause the trustee first did not advertise the sale in the paper, seconded the trustee was in California on the date of the auction, thats the way she and the notary signs the trustee deed upon sale, mind you the property is locate in phoenix and third they never report the foreclosure to the IRS and maybe more but I would have to keep digging. This investor broker kept my name on the loan for over a year after foreclosure and the senior lender kept my name on the homeowners insurance for two years. I have proof of everything I state here and more soon. He works with both lenders. Oh they also kept my name of the trustee deed upon sales.

Re: illegal foreclosure

You raise a very interesting story, but have not provided enough facts, nor have you really asked a clear question. I can't answer your question without knowing who the 2 lenders are and who foreclosed on which loan, who the broker is, if the broker and the investor are the same person, and much more.

If you want to consult with me, I will meet with you and review the facts of the case and your documentation, for a fixed fee and without any further obligation. That way I can analize what you want and advise you accordingly.
