Legal Question in Real Estate Law in Arizona

responding to a judgement

Some one is attempting to put a judgement against me. They have filed with the court and sent me what they filed. Can I respond to the court before the judgement takes place. The information the party is giving to the court is false. The property being sought does belong to the party. The judge did tell me to work this out with the other party. I live in Alaska,He lives in Florida, property is in Arizona. When we were both in Arizona three years ago I could have given him the property but he was unable to meet with me to do so. Have not heard any thing since then till now(three years later)

Re: responding to a judgement

I presume that by "attempting to file a judgment" that you mean you have received a complaint filed by a plaintiff in a court case requesting a judgment. You have the time stated on the summons (accompanied the complaint) to file a proper written answer to the complaint. Get an Arizona attorney if this is an Arizona lawsuit to file the answer and represent you. If the case can be settled, that can be pursued by your attorney. I do not advise you to attempt to defend yourself. If you do not timely file the proper court pleading, a default judgment can be entered against you. Because your description of the events and the suit is somewhat confused, I advise against representing yourself in this matter. Get an attorney immediately. You are always welcome to speak with us.

Good luck,

James D. Jenkins
