Legal Question in Real Estate Law in Arizona

Trust

Our home is in a trust and we want to re-finance. We must take it out of the trust to do this. How do we take our home out of the trust?

Re: Trust

The title company handling the refinance should be able to prepare the necessary deeds. (They SHOULD prepare two deeds; 1 to take the house out of the trust and than a 2nd one to put the house back in)

If the title company won't do it, then talk to the lawyer that did your trust, and maybe he/she will do it.

If that doesn't work, then find a new lawyer to do it for you.

Re: Trust

Deed the home from the trustees to yourselves, then deed it back in after the re-finance. Make sure the deeds are correctly worded. See an attorney.
