not filed taxes?

Is it public information to be able to find out if someone filed tax returns or is behind in filing tax returns for a given year(s) if so how?

At the state and local level, taxpayer information is totally confidential, with the exception of property taxes. I'm sure this also is the case with federal taxes although I don't know off the top of my head.

The answer to your question depends on if the filing party is a corporation or not. If the filing or possibly failing to file party is a corporation, you can get copies of their tax returns. If on the other hand the filing or failing to file party is an individual, then those returns are confidential, however they may be obtained in discovery motions if tax returns are relevant.

On another issue, however tangently related, if you wish to report a person for non-filing of taxes, and are willing to go on record, then you can file a form 211 with the IRS. If a recovery results in financial gain to the IRS you may be eligible for a reward. The cap of the reward is $1 mil. and is based on the percentage of the amount discovered and recovered.
