In Arizona, the refusal itself is what is causing the problem with your license, whether you were ultimately charged with a DUI or not. There is a limited period of time during which you may be eligible to request a hearing with the AZ MVD on the issue of your refusal. The rights you have will be listed on the back of the form you were provided by the law enforcement agency. You are permitted to have an attorney represent you at any hearing on your license issues, and an experienced attorney may be able to help you in this situation with the MVD after reviewing all of the facts and circumstances. Feel free to call me.

You need to consult and retain counsel to represent you before the MVD at a hearing.
